At Westend Consultants, we understand that family unity is paramount when relocating to the UK. Whether you're on a Skilled Worker visa, Global Talent visa, or another PBS route, bringing your spouse and children requires careful planning and proper documentation. This guide will walk you through every step of the PBS Dependant Visa process.
What is a PBS Dependant Visa UK?
A PBS Dependant Visa UK allows family members of Points-Based System visa holders to live, work, and study in the United Kingdom. This visa category is specifically designed for spouses, civil partners, unmarried partners, and dependent children of individuals holding eligible UK work visas.
The PBS Dependant Visa aligns with the main applicant's visa duration and provides similar rights and privileges. Unlike visitor visas, dependant visas offer long-term residence solutions with pathways to settlement.
Eligible main visa routes under PBS include:
- Skilled Worker visa
- Global Talent visa
- Innovator Founder visa
- Minister of Religion visa
- International Sportsperson visa
- Representative of an Overseas Business visa
Who Can Apply as a PBS Dependant?
Understanding UK Dependant Visa eligibility is crucial for a successful application. The UK immigration system recognizes several categories of dependants:
Spouse or Civil Partner Your legally married spouse or registered civil partner can apply as your dependant. The marriage or civil partnership must be legally recognized in the UK.
Unmarried Partner If you're in a genuine relationship similar to marriage and have been living together for at least two years, your partner may qualify. You'll need substantial evidence of cohabitation and shared financial responsibilities.
Dependent Children Under 18 All biological children, adopted children, and step-children under 18 can apply as dependants. The child must not be married or in a civil partnership and should be financially dependent on you.
Children Over 18 Already in the UK If your child is already in the UK as your dependant and turns 18, they can continue as a dependant until their current visa expires, provided they remain unmarried and financially dependent.
Special Cases Adopted children with legal documentation and children under legal guardianship may also qualify under specific circumstances.PBS Dependant Visa Requirements
Meeting PBS Dependant Visa requirements is essential for approval. The UK Home Office evaluates applications based on several key criteria:
1. Relationship Evidence:
You must prove your genuine relationship through official documents. Marriage certificates, civil partnership certificates, or cohabitation evidence spanning two years are mandatory. Bank statements, joint tenancy agreements, and utility bills in both names strengthen your application.
2. Financial Requirements:
While there's no specific income threshold for PBS dependants, you must demonstrate adequate maintenance funds. The main applicant should show they can support dependants without relying on public funds. Bank statements covering three months typically suffice.
3. Valid Visa Status:
The main applicant must hold a valid PBS visa or have submitted an application for extension or settlement. Dependants cannot apply if the main applicant's visa has expired without a pending application.
4. English Language Requirement:
Most adult dependants don't need to meet English language requirements initially. However, this may apply when extending or applying for settlement.
5. Tuberculosis Test:
Applicants from certain countries must undergo TB testing at approved clinics before application submission.
How to Apply for a PBS Dependant Visa: Step-by-Step Guide
Navigating the UK visa for family members application process requires careful attention to detail. Here's your complete roadmap:
Step 1: Online Application
Complete the appropriate online form on the UK government website. Choose between applying from outside the UK or switching from within the UK, depending on your circumstances.
Step 2: Document Preparation
Gather all required documents including relationship evidence, financial documents, passport copies, and photographs. Ensure all foreign documents are translated and certified.
Step 3: Biometric Appointment
Book and attend a biometric appointment at a visa application center. You'll provide fingerprints and photographs for your Biometric Residence Permit (BRP).
Step 4: Fee Payment:
Pay the visa application fee and Immigration Health Surcharge (IHS). Fees vary based on application type and duration.
Step 5: Application Submission
Submit your complete application with supporting documents. Applications from outside the UK typically take 3-12 weeks for processing.
Step 6: Decision and Collection:
Receive your decision and collect your BRP if successful. The BRP serves as proof of your right to live and work in the UK.
Switching to a PBS Dependant Visa from Within the UK
Many individuals already in the UK on different visas can switch to Dependant Visa UK without leaving the country. This process offers convenience but requires meeting specific criteria.
Eligible Visa Categories for Switching:
- Student visa holders
- Visitor visa holders (limited circumstances)
- Tier 4 dependants
- Other work visa dependants
Switching Process The online application process is similar to applying from abroad, but you must apply before your current visa expires. Ensure you meet all dependant visa requirements and maintain valid status throughout the process.
Visa Conditions: What Rights Do Dependants Have?
Understanding UK work rights for dependants and other entitlements helps families plan their UK life effectively.
Work Rights PBS dependants can work in most jobs without restrictions. Unlike some visa categories, there are no limitations on employment type or hours worked. This flexibility allows dependants to pursue careers and contribute to household income.
Study Rights Children can attend state schools free of charge. Adults can pursue further education, though international student fees may apply for higher education courses.
NHS Access Payment of the Immigration Health Surcharge provides access to NHS services. This covers most medical treatments but may exclude certain specialized services.
Key Restrictions The "no recourse to public funds" condition applies to most dependant visas. This means you cannot claim most benefits, tax credits, or social housing assistance.
Duration & Extension of PBS Dependant Visa
UK Dependant Visa processing time and duration align with the main applicant's visa. Understanding these timelines helps with long-term planning.
Initial Validity First-time dependant visas typically match the main applicant's remaining visa duration. If the main applicant has three years remaining, dependants will receive the same duration.
Extension Requirements When the main applicant extends their visa, dependants must apply for extensions simultaneously or separately. The relationship must remain genuine, and financial requirements must still be met.
Application Timing Submit extension applications no earlier than three months before expiry. Late applications may result in loss of legal status and complicate future applications.
Can PBS Dependants Apply for Indefinite Leave to Remain (ILR)?
The pathway to ILR for PBS dependants offers long-term security and eventual British citizenship opportunities.
- 1. Eligibility Criteria
Dependants can apply for ILR after five years of continuous residence in the UK. This period must be spent as a dependant of someone in a qualifying immigration category.
2. Continuous Residence RequirementYou must not have spent more than 180 days outside the UK in any 12-month period during the five-year qualifying period. Brief absences for holidays or business are acceptable.
3. Application ProcessDependants can apply for ILR alongside the main applicant or separately. Each family member requires a separate application and fee payment.
4. Benefits of ILRILR removes visa restrictions and provides access to public funds. After 12 months with ILR, you can apply for British citizenship.
